On Christmas Eve in 2024, Andrea Smith-Taylor was shopping for gifts for her five children while residing in a domestic violence shelter. She purchased various items including clothing, jewelry, and a PlayStation, only to have them seized when she was arrested, with her case later being dismissed and sealed. Despite the charges being dropped, she did not recover the gifts nor the $3,500 in cash she had on her that day.
Smith-Taylor is one of six plaintiffs in a lawsuit against the City of New York, the NYPD property clerk, and Police Commissioner Jessica Tisch, claiming the property reclaim process is excessively complicated and burdensome. The lawsuit highlights the broader issue of how New Yorkers struggle to retrieve items taken by law enforcement, which can often lead to their belongings being lost, sold, or destroyed without adequate recourse.
